1961 July 17 from W. J. Toohey to Elmer Glick re: Mr. James H. Pierce who thinks that the lessee has violated the terms of the lease by strip mining without much underground mining. Toohey suggests possibility of fraud. On inquiry Toohey was advised that as recently as September 1, 1960 the upper level of Franklin Colliery was being operated.
