Toohey suggests possibility of fraud. On inquiry Toohey was advised that as recently as September 1, 1960 the upper level of Franklin Colliery was being operated.

Toohey to Elmer Glick re: Mr. James Pierce will be in Bethlehem July 21, 1961 to meet with somebody from Union Bank as the Substituted Liquidating Agent for the Estate of Asa Packer and R. S. Taylor, Jr. the attorney for the Estate of Asa Packer to discuss some phases of the lease of June 1, 1889 executed by E. P. Wilbur et al, as lessors and Lehigh Valley Coal Co. as lessee. Mr. Pierce says that portions of lease do not lend themselves to arbitration.
